Argyll and Bute Council Constitution - 25. Scrutiny of the Policy and Resources, Community Services and Environment, Development and Infrastructure Committees (CS)

  1. Where on the consideration by the Policy and Resources, Community Services and Environment, Development and Infrastructure Committees of any item of business, not fewer than nine Members of the Council, at least four of whom are elected Members of the relevant Committee, require immediately at the time the decision is taken (but not otherwise) that the decision should be subject to scrutiny by the Council then, subject to paragraph 2 below, the decision shall be treated as a recommendation to the Council for consideration and determination.
     
  2. Paragraph 1 above shall not apply to any decision which arises on an item of business:–
    1. Where –
      1. the Committee has considered a matter where the decision may affect the interests of any person as an individual; and
      2. the decision is made after a hearing by the Committee where the person has a right in terms of any law, standing order or administrative procedure, to be heard in person or by a representative, or
    2. Where, in the opinion of the Chairman, there is a requirement that the decision be given effect to before the next ordinary meeting of the Council
