Asset Transfer under the Community Empowerment (Scotland) Act 2015

NOTICE OF REVIEW OF ASSET TRANSFER REQUEST

A request to review the decision to refuse the asset transfer request has been made to Argyll and Bute Council under Part 5 of the Community Empowerment (Scotland) Act 2015.

A request for a review has been made by the Isle of Gigha Heritage Trust of the refusal of the asset transfer request on 17th May 2019.

The assertions made for a review

  • That the benefits of such a transfer have not been properly considered.
  • The management and control of the car park is having an effect on the island.
  • The councils lack of consultation with IGHT.
  • That the council has not given sufficient weight to the proposal put forward.
  • That the council have not offered any alternative proposal.

The Council will evaluate the review and must issue a decision notice to the Organisation who made the request within six months from the date on which the application for review was made.
