What information do we need?
The information we collect from you will include details such as your name, address, telephone numbers, e-mail address, date of birth and job title.
For the purposes of this specific service, the personal data we require includes special category information about you (also known as “sensitive personal data”), specifically including information about racial or ethnic origin; political opinions; religious or philosophical beliefs; genetic and biometric data, health; sex life or sexual orientation.
The information we collect can relate to personal and family details; education, training and employment details; financial details; lifestyle and social circumstances and information obtained from within council records.
We also need to ask about all members of your household, in particular adults including current and previous partners.
Why we need this information?
Your information is being collected for the following purpose(s): -
We use this information to enable us to provide our Kinship services; supporting and managing applicants; maintaining our accounts and records; public protection.
If you do not provide this information, then we will be unable to progress your application to become kinship carers.
We will not collect any personal data from you that isn’t needed for our consideration of your application to be assessed and approved as kinship carers and our ongoing service to you following approval.
The lawful bases for collecting your personal information in these circumstances are:
Article 6(1)(a) Consent – we will obtain your consent to process your personal information as part of the application process and the processing of this information is required to approve you as kinship carers.
Article 6(1)(c) Legal obligation: to comply with the requirements of the Looked After Children (Scotland) Regulations 2009, Protection of Vulnerable Groups (Scotland) Act 2007, Police Act 1997, National Care Standards.
Article 6(1)(e) Public task – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council.
The lawful bases for collecting your special category personal information in these circumstances are:
Article 9(2)(a) Consent - we will obtain your consent to process your special category personal information as part of the application process and the processing of this information is required to approve you as kinship carers.
Article 9(2)(h) - for the management of social care systems and services and to ensure appropriate safeguarding measures are in place.
What we will do with your information?
In order to progress any application you make, we will be required to share some or all of your information with the agencies listed below
- Disclosure Scotland - PVG check (Protecting Vulnerable Groups)
- Other Council Services for current/previous addresses
- Other public bodies including the Police and other local authorities
- Current/Previous employers (including voluntary positions)
- Schools and colleges currently attended by your children
- Health visitors currently allocated to your children
- Ofsted/Education Scotland
- Personal referees (as listed in your application form)
- Children, including adult children
- Former partners
- State embassy for another country where you have lived
All of the information we collect from you will be processed by staff in the United Kingdom. You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.
How long will we keep your information?
Your information will be held for a period of 25 years from the end date of the last kinship placement or following your death, if this is earlier. After this period, it will be destroyed under secure arrangements. More information on our retention schedule is provided on the Council website (www.argyll-bute.gov.uk ) or can be provided in paper format on request.
Your Rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the lawful basis specified above is consent
- to lodge a complaint with the Information Commissioner’s Office – see below for details
- to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
- to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
