Code of Conduct

The Code of Conduct applies to all parties to the Landlord-to-Landlord Sales Scheme. Communications and negotiations between parties must be respectful, honest and reasonable at all times without undue persistence or time pressures being introduced. Participants must ensure that no action or omission on your part is detrimental to the interests of the scheme. The Council shall be entitled to determine what they consider to be detrimental. 

Information distributed through the Landlord-to-Landlord Sales scheme is intended for registered buyers/sellers only. Please be aware that this information is not to be shared with external parties or third parties. Failure to meet the standards and requirements of the code of conduct may result in your removal from the scheme.

The purpose of the Landlord-to-Landlord Sales scheme is to match buyers and owners registered under this scheme who are considering selling their property with a sitting tenant. It does not constitute professional advice and is not a substitute for any legal processes associated with selling and buying property. 

The Council is not acting as your commercial agent in operation of this scheme and all negotiations and sales processes take place between the seller and buyer. 

The Council is not acting as an agent for any party and it is strongly recommended that all potential buyers carry out their own checks and inspections and independent legal advice is obtained before entering into any contract or other legally binding document, in addition to undertaking appropriate investigations into the responsibilities and requirements associated with being a landlord. The Council will not be liable to any party be they a registered buyer or registered seller for any matter arising directly or indirectly from providing contact details to another person under this scheme. 

Please note that under the Housing (Scotland) Act 2006 it is a legal requirement in Scotland for any property which is “on the market” to have a Home Report. Owners who are considering selling but have not yet taken the step of getting a Home Report may register with the scheme, however they should not enter into any negotiations with potential purchasers until a Home Report has been acquired. 

If you are a private landlord letting residential property in Scotland, you are legally required under Part 8 of the Anti Social Behaviour etc. (Scotland) Act 2004 to register with the Local Authority where the let houses are located unless all of the houses you let are covered by one or more of the exemptions. By providing your details you agree to your information being shared with registered sellers of leased homes participating in this scheme, who are seeking to sell a property which matches your chosen criteria.

By submitting an application form to register with the Argyll & Bute Council Landlord-to-Landlord Sales Scheme you are hereby confirming that: 

  1. To the best of your knowledge, the details that you have entered on your application form are true and accurate. 
  2. You understand that the information you have provided in this application form will be held on our database and used by the Argyll & Bute Council Housing Strategy Team. 
  3. You agree to the Council passing on to the relevant registered sellers your name, contact phone number, and email address, in the event that you choose to declare an interest in any particular property(ies).
  4. You understand that Argyll & Bute Council are not acting as an agent in the operation of this scheme, and we will not be liable to any party be they a registered buyer or registered homeowner for any matter arising directly or indirectly from providing contact details to another person under this scheme.
  5. You agree to adhere to the standards highlighted within the above Code of Conduct and understand that failure to meet these standards may result in your removal from the scheme.

What happens next?

The Private Sector Settlement Officer will contact you to confirm receipt of your form. A notification will be sent to you if any properties relevant to your chosen criteria are registered with the scheme, and this information will be shared regularly while you remain signed up to participate in the scheme.

To register your interest in any of these properties, please advise the Private Sector Settlement Officer, who will share contact details between the two parties. The two parties (the potential purchaser and the property owner) can then take forward discussions about the sale of the property, either directly or through their agents.
