A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

Your Personal Data

What information do we need?

Argyll and Bute Council will act as the ‘Data Controller’ for the personal data you provide to us. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

The information we collect from you will be your name, address, phone number and e-mail address. For prospective sellers, this will also include details of the property for sale and associated tenancy details. For prospective buyers, this will also include details of the type of property you are interested in purchasing. 

Why we need this information?

Your information is being collected for the following purpose:-

To allow the Housing Services team to facilitate a matchmaking database for prospective sellers and buyers of properties with sitting tenants as part of the Landlord-to-Landlord Sales scheme. 

We need to know this personal data in order for interested parties to participate in the scheme. If you do not provide this information, then we will be unable to facilitate your participation in the scheme. We will not collect any personal data from you that isn’t needed for delivery of those services.

The lawful basis for collecting your information in these circumstances is: -

  • Article 6(1)(a) – Consent – you are consenting to the processing of your personal information through submission of the scheme’s application form.

What we will do with your information?

The information that you provide within this application shall be held on a matchmaking database controlled and operated by Argyll & Bute Council’s Housing Strategy Team.

‘Sellers’ who register with this scheme should be aware that the property details they have included will be distributed to all appropriate registered buyers. If a ‘Buyer’ declares an interest in a property then the ‘Sellers’ personal information will be shared with the ‘Buyer’ in order to generate a communication link. The following personal information will be shared: contact name; contact telephone number; email address and property details.

‘Buyers’ should be aware that if they choose to declare an interest in any property then personal information will be shared with the appropriate ‘Seller’ in order to generate a communication link.  The following personal information will be shared: contact name; contact telephone number; contact email address. 

All of the information we collect from you will be processed by staff in the United Kingdom. You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union.  We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.

How long will we keep your information?

We will keep your information for a minimum of one year, after this period we will contact you to confirm whether you wish to remain as a participant of the scheme. If you do not, your information will be deleted from our records as it would no longer be required for the lawful purpose for which it was obtained. You can withdraw from participation in the scheme at any time and once you advise us of that your information will be deleted from our records.

Automated Decision Making

No automated decision making will take place in relation to this scheme. 

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the lawful basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office – see below for details
  • to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract 
  • to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
