A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

What information do we need?

Argyll and Bute Council will act as the ‘Data Controller’ for the personal data you provide to us. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

The information will include details such as your name, address, e-mail address, job title, qualifications, and business details.  However in some case we may need to ask you for more personal information which is described in the legislation as Special Category Data or sensitive personal information.

For the purposes of inspections and investigations, the personal data we require may include special category information about you (also known as ‘sensitive personal data’) which may include details of health.

Why we need this information?

You are giving us your personal information to allow us to process enquiries, conduct investigations and inspections and carry out statutory undertakings including protecting Public Health, the rights of Consumers, combatting and preventing crime and as the Statutory Food Authority.

We need to know this information in order to:

  • To provide you with the services we provide
  • To provide you with the services you have requested
  • To verify your identity where required,
  • To contact you by post, email or telephone and
  • To maintain our records

For the purposes of inspections and investigations we will also process your information for;

  • Records of incidents to allow the monitoring of public health.

If you do not provide this information then we will be unable to provide those services to you.  We will not collect any personal data from you that isn’t needed for delivery of those services.

Our legal basis for processing your information:

Legal obligation – processing is necessary for compliance with a legal obligation under:

  • Trading Standards - The Weights and Measures Act 1985, Consumer Protection from Unfair Trading Regulation 2009, Consumer Rights Act 2015, or related criminal legislation.
  • Environmental Health - Health and Safety at Work etc. Act 1974 (HSWA),  Private Landlord Register, Anti-Social Behaviour Etc. (Scotland) Act 2004,
  • Food Safety - Food Safety Act
  • Animal Health - Animal Health Act 1981 and other associated legislation in relation to Animal Health and Welfare.

When we are required to collect the more sensitive type of personal information, our legal basis is that we require the information:

  • For the management of public health

What we will do with your information?

In order to provide this service(s), we will share your information with the service / agencies listed below for the purposes specified

  • Other public bodies (and also receive information from these other bodies) for the purpose protecting public health i.e. Scottish Water, NHS Highland and Islands
  • Regulatory and law enforcement bodies in compliance with legal obligations including Police, SEPA, Food Standards Scotland, Trading Standards Scotland
  • Scottish Government and other Council services to help us improve our services

When you do not provide information directly to us, we may receive it from other relevant organisations including add details as relevant to this service function e.g. other Council services, NHS Boards, GPs, Local Authorities; Police 

UK or International Data Processing

All of the information we collect from you will be processed by staff in the United Kingdom.  Your data will be stored on servers located in within the United Kingdom, the data will not be processed outside the European Union.  We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be provided by the Data Protection Officer if required.

How long will we keep your information?

Initial enquiry details will usually be kept until contact has been established, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. Subsequent records generated by the creation of an application or investigation will be subject to the applicable retention period.  More information on our retention schedule can be provided by the Data Protection Officer if required.

Automated Decision Making

There are no Automated Decision Making systems used for any of the purposes identified above.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the lawful basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office – see below for details
  • to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
