Why do we need this information?
You have chosen to communicate with Argyll and Bute Council on whether designation of one or more Short-Term Let Control Areas would be an appropriate and proportionate planning intervention.
The information will help us to understand who has responded, assess views and evidence, identify themes, prepare reports and recommendations, and support transparent and lawful decision-making. The information we collect from you will be:
- the area in which you live, work, own or operate property, or otherwise have an interest;
- whether you are responding as a resident, business, community council, organisation, existing or prospective short-term let operator, property owner or another interested party;
- information about short-term let activity, property ownership, property use, housing circumstances or business activity that you choose to provide;
- your consultation answers, opinions, comments and supporting information or documents;
Please avoid including unnecessary personal information about yourself or other people in free-text answers or supporting documents.
The lawful basis for collecting your information in these circumstances is that:-
- Article 6(1)(a) – Consent – you are consenting to the processing of your personal information through submission of the form
- Article 6(1)(e) – Public Task - processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council
What we will do with your information?
We may share your personal data and feedback to the Development & Economic Growth, Legal & Regulatory Support and the Chief Executive’s Unit within the Council who are responsible for carrying out an analysis of responses. Findings of the Consultation will be published and shared with Council Committees, but these will not contain any personal data. The findings will also be shared with the Scottish Government.
Your data will be stored on servers located within the United Kingdom. We will take all reasonable steps to ensure that your data is kept secure, and more information on how we do this can be provided by contacting the Data Protection Officer (contact details can be found above).
The Council has a number of AI (Artificial Intelligence) systems in use, most notably Microsoft Copilot. These systems are used as productivity assistants and the data is kept securely within the Council Network.
These AI systems do not make decisions for the Council. All AI-generated content requires to be manually checked/verified before it is used operationally.
How long will we keep your information?
Your personal information will only be kept for 6 years following the final Council decision on the Short-Term Let Control Area proposal, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained.

Automated Decision Making
No automated decision making will take place.
Your Rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the legal basis specified above is consent (not applicable)
- to lodge a complaint with the Information Commissioner’s Office – see below for details
- to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract (not applicable)
- to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
