Play Sufficiency Assessment Parents, Carers and Adults survey - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

What information do we need?

Argyll and Bute Council will act as the ‘Data Controller’ in regard to the personal data you provide to us. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

Why we need this information?

You are giving us your personal information to allow us to analyse and interpret engagement responses in relation to assessing the sufficiency of outdoor play opportunities within the Argyll and Bute Local Planning Authority area and also to be able to monitor who has responded to the engagement activity. 

The personal information will include your age and where you live.

The special category information (gender, disability, religious belief, ethnicity, including gypsy and traveller status, and sexual orientation) would be beneficial for us as it will allow us to more fully assess the sufficiency of outdoor play opportunities and also to be able to monitor who has responded to the engagement activity although providing this information is optional.

We need to know this information in order to:

  • Write and publish the play sufficiency assessment
  • Help inform the development of the Argyll and Bute Local Development Plan 3
  • Understand and monitor who has responded to the engagement

Our legal basis for processing your information:

  • Article 6(1)(e) Public task – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council under:
    • Town and Country Planning (Scotland) Act 1997,
    • Planning (Scotland) Act 2019
    • The Town and Country Planning (Play Sufficiency Assessment) (Scotland) Regulations 2023
  • Article 6(1)(a) Consent – Consent – you are consenting to the processing of your personal information through submission of the form
  • Article 9(2)(a) Consent – you are consenting to the processing of your special category personal information through the completion of the Equal Opportunities information and submission of the form

What we will do with your information?

In order to more fully assess the sufficiency of outdoor play opportunities and monitor who has responded to the engagement, any personal information provided and comments made regarding the play sufficiency assessment will be recorded by Argyll and Bute Council.

Comments may be published through play sufficiency assessment reporting and may be made available online to the public. Personal data might be published in an aggregated form either as standalone data or alongside comments. Personal data will not be published in a manner that would allow individuals to be identified.

Argyll and Bute Council may share this data with:-

  • Other Council services to help us improve our services, including Development Management, Roads and Amenity Services and Economic Development and Community Development.
  • Council information technology officers for purposes of processing data and information. 

UK or International Data Processing

All of the information we collect from you will be processed by staff in the United Kingdom. You should be aware however that your data will be stored on servers located within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website (www.argyll-bute.gov.uk ) or can be provided in paper format on request to ldp@argyll-bute.gov.uk

How long will we keep your information?

We will usually keep your personal information for 3 months after the Local Development Plan 3 is formally adopted (estimate in 2029), after this period it will be destroyed under secure arrangements. Automated Decision Making

There are no Automated Decision Making systems used for any of the purposes identified above.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the legal basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office (www.ico.org.uk)
  • to request access to your personal data
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as so far as the legislation permits

The Council’s Data Protection Officer will ensure that personal information is handled in compliance with data protection law, contact details are noted in the first paragraph of this notice.
