What information do we need?

Why we need this information?
We will ask you how old you are and where you live to help us to understand whether the current outdoor play areas are good enough for the children in Argyll and Bute and to find out what you think about other kinds of outdoor play to inform the development of the Argyll and Bute Local Development Plan 3
Our legal basis for processing your information:
- Article 6(1)(e) Public task – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council under:
- Town and Country Planning (Scotland) Act 1997,
- Planning (Scotland) Act 2019
- The Town and Country Planning (Play Sufficiency Assessment) (Scotland) Regulations 2023
- Article 6(1)(a) - Consent – you are consenting to the processing of your personal information through submission of the form
What we will do with your information?
We may publish your responses on our website and in reports as part of the process we have to follow for the Local Development Plan 3 but no one will know this is you.
Argyll and Bute Council may share this data with:-
- Other Council services to help us improve our services, including, Development Management, Roads and Amenity Services and Economic Development and Community Development.
- Council information technology officers for purposes of processing data and information.
UK or International Data Processing
All of the information we collect from you will be processed by staff in the United Kingdom. You should be aware however that your data will be stored on servers located within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website (www.argyll-bute.gov.uk) or can be provided in paper format on request to ldp@argyll-bute.gov.uk
How long will we keep your information?
We will usually keep your personal information for 3 months after the Local Development Plan 3 is formally adopted (estimate in 2029), after this period it will be destroyed under secure arrangements. Automated Decision Making
There are no Automated Decision Making systems used for any of the purposes identified above.
Your Rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the legal basis specified above is consent
- to lodge a complaint with the Information Commissioner’s Office (www.ico.org.uk)
- to request access to your personal data
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
- to request rectification or erasure of your personal data, as so far as the legislation permits
