Early Years Partner Providers - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

What information do we need?

Argyll and Bute Council will act as the ‘Data Controller’ in regard to the personal data you provide to us. The Data Protection Officer can be contacted at the Council’s headquarters is at Kilmory, Lochgilphead PA31 8RT.  The email address is: data.protection@argyll-bute.gov.uk   

Unless specifically agreed with you, we will only collect personal data about you which does not include any special categories of personal information about you (also known as ‘sensitive personal data’.  The information will however include details such as your business name, manager contact details including name as detailed in the Profile of Education Provision for Early Learning and Childcare form and SEEMiS staff application form.

Why we need this information?

Your information is being collected for the following purpose:

To work in partnership with you to deliver Early Learning and Childcare and Childminding services.

We need to know this basic personal data in order to provide you with the services we provide and to establish our rights in relation to those services, as detailed in the contract (or service agreement) we have with you.  If you do not provide this information then we will be unable to work in partnership with you.  We will not collect any personal data from you that isn’t needed for delivery of those services.

The legal bases for collecting your information in these circumstances are:

Performance of a contract: your Early Years’ contract requires information to be provided; if this information isn’t provided then Early Years will be unable to use you as a partnership provider helping to deliver Early Years’ services.

Public Interest: The Council are acting in the public interest in securing Early Learning and Childcare at a variety of settings to allow parental flexibility as outlined in the Children and Young People Act 2014.

All of the information we collect from you will be processed by staff in the United Kingdom.

Your business information will be made public by the Early Years team to allow parents to make a choice about which Early Learning and Childcare setting they wish to use. This may include the Manager of the setting name.

If you undertake any formal professional development awards through the Council your details will be shared with your chosen Training Provider and/or the necessary examination boards.

In order to access the management information system Nursery Admission Management System (NAMS) used by the Education department staff details will be shared with SEEMiS.

Your name and job title may also be held in files for CPD purposes and in minutes of meetings you may attend.

You should also be aware that your data will be stored on servers located within the United Kingdom; the data will not be processed outside the European Union.We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website (www.argyll-bute.gov.uk ) or can be provided in paper format on request to Sheena Stewart on 01369 708517.

How long will we keep your information?

We will usually keep your information for a maximum of 6 years after you cease to be a partner provider with us, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose(s) for which it was obtained.  More information on our retention schedule is provided on the Council website (www.argyll-bute.gov.uk ) or can be provided in paper format on request to Sheena Stewart on 01369 708517.

Automated Decision Making

No automated decision making will be undertaken.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the legal basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office
  • to request access to your personal data
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as so far as the legislation permits
