Your Personal Data

What information do we need? 

Argyll and Bute Council will act as the ‘Data Controller’ for the personal data you provide to us. 1The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

The information we collect from you will be your name, address, e-mail address and position in organisation.

Why we need this information?

Your information is being collected to allow the Council to consider your submission of an Expression of Interest for external funding for your project and to contact you in relation to that. 

If your Expression of Interest/Project meets the criteria of a specific external fund, we may contact you to advise of its suitability and to ask if you would like to proceed to application stage with the external funder. 

Our legal basis for processing your information:

  • Article 6(1)(a) Consent – you are consenting to the processing of your personal information through submission of the form

What we will do with your information?

In order to assess your Expression of Interest, we will share your information with other Council Services, such as Community Development and Economic Growth as your project may be suitable for the grant funding schemes they administer. To ensure the organisation has no arrears with the Council, we will ask our Finance Department to check whether the organisation has any outstanding debts to the Council.

If your Expression of Interest/Project does not meet the criteria, the Council will contact you to advise of this. 

If your Expression of Interest/Project meets the criteria of a specific external fund and is selected to proceed to application stage, the Council will contact you to advise of its suitability and ask if you would like to proceed to application stage with the external funder. The external funder will usually be the Scottish Government. 

Your organisation name and details of your project will be included within reports to committees within the Council to seek agreement to include your project in any potential funding opportunities, personal contact information will not be included in any such report. If you proceed to application stage, your application will be shared with the Scottish Government or any other bodies related to assessment and delivery of external funds such as The Scottish Futures Trust. In your application, you will provide further personal data such as banking details to allow payment of the grant, should you be successful. The Council will provide the information, including any privacy information, issued by the grant operator for your consideration.

If your project is successful, your organisation name and amount awarded may appear on the Scottish Government and Council’s website and through news releases. 

All of the information we collect from you will be processed by staff in the United Kingdom. You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.

How long will we keep your information?

If your project does not meet the criteria, we will retain the details of your submission for a period of6 years and may contact you, should it be suitable for other funding

Where your project meets the criteria, we will retain the details of your submission for a period of 6 years.

If your project progresses to an application for external funding, we will retain the details of your submission for a period of 6 years.

After the above applicable period, it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. More information on our retention policy and procedure can be obtained from the Data Protection Officer if required.

Automated Decision Making

No automated decision making will take place.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the lawful basis specified above is consent.
  • to lodge a complaint with the Information Commissioner’s Office – see below for details.
  • to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract.
  • to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
