Independent Regulatory Challenge Panel

The Independent Regulatory Challenge Panel will look into complaints regarding advice given by HSE or local authority (LA) inspectors about health and safety which you think is incorrect or goes beyond what is required to control the risk adequately. The panel will consist of independent members who will have the competence and experience to assess advice that has been given on regulatory matters.

Argyll and Bute Council are committed to giving sensible health and safety advice based upon risk. If you are not satisfied with the requirements or advice you receive, please contact the inspector to discuss your concerns. If the inspector cannot assist you, you can raise your concerns through the Council’s Complaints Page.

Formal notices

If you have received a formal improvement notice or prohibition notice under the Health and Safety at Work etc. Act 1974, there are legal rules about appealing the notice. These will be set out in the notice and the accompanying information. Your right to appeal expires after 21 days, so act quickly if you wish to challenge a formal notice.

Extension of notices

Provided no appeal is pending, and if there are compelling reasons, the inspector will consider reasonable and justified requests for extending the period for compliance with a notice. A request can only be made before the expiry of the period for compliance of the notice and must be in writing. All requests will be considered carefully and receive a written response, but the inspector is under no obligation to grant an extension.
