Report by Executive Director with responsibility for Commercial Services

On 15 August 2024, the Policy and Resources Committee authorised officers to proceed with negotiations to agree detailed Heads of Terms with Forrest Developments Ltd in advance of a potential sale of the Helensburgh Waterfront commercial area. Following this, Helensburgh Community Council submitted a petition for Judicial Review of the proposed sale, which was decided in the Council’s favour on 19 November 2025. In the intervening period, a number of additional issues were also resolved.

The Committee gave consideration to a report providing an update on the current position along with recommendations from the Council’s legal advisers.

Decision

The Policy and Resources Committee –

1.    noted the outcome of the Judicial Review and the progress that had been made addressing the other outstanding issues to progress the sale and development of the site;

2.    noted that the Council’s legal advisers had identified actions required as part of the legal due diligence process; and

3.    agreed that officers carry out a consultation in terms of section 104 of the Community Empowerment Act 2015 and report the outcome of this back to a future Policy & Resources Committee.
