Minutes: The Chair welcomed everyone to the meeting and introductions were made. He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Reppke who would provide procedural advice if required. Mr Reppke explained that
a the first calling of this LRB the panel decided to hold an accompanied site
visit, subject to checking the accessibility of the site. Mr Reppke advised that having explored a
number of options, including having considered access by the water by way of a
rib, it was of his opinion on grounds of health and safety that the panel would
not be able to make their way safely to the shore location. On that basis he advised that the LRB request
that both the Applicant and the Planning Department provide photographs of the
location allowing each the opportunity to comment on the photographs. Mr Reppke
advised both the Applicant and the Planning Department have been made aware of
his opinion The Chair and the other
Members of the LRB agreed that a site visit was not practical and they will
request further information in the form of photographs from the Applicant and
the Planning Department. The LRB and Mr Reppke
discussed the merits of an ACE and that the assessment was the opinion of a
planning officer and for the LRB Members to critique that assessment as
appropriate. The Chair discussed that
in relation to the curtilage of the building that in the further submissions planning
have commented about doubts of ownership.
The Chair and the other LRB Members agreed to seek clarity on this from
the Planning Department. Councillor Blair
expressed his concerns with the length of time passed in coming to a decision
on this application and Mr Reppke advised that at this calling the LRB could
ask for model conditions and reasons if the LRB minded to grant planning
permission. Councillor Devon and Councillor Blair stated that it would be beneficial if the Planning Department could provide details as to where the blue area is in the plans as referenced in their report. Decision The Argyll and Bute Local Review Body unanimously agreed; 1. to request further written submissions from the Planning Department in respect of; a) a model set of conditions and reasons if the LRB minded to grant planning permission; b) details on ownership of the land; c) details as to where the blue area is in the plans as referenced in their report; d) photographs of the location; and e) to provide further commentary on the merits of application as against the ACE assessment. 2. to request photographs of the location by the Applicant; and 3. to adjourn the meeting and reconvene at the earliest opportunity.
