There were no apologies for absence intimated.

There were no declarations of interest.

The Chair welcomed everyone to the meeting and introductions were made.  He explained that no person would present would be entitled to speak other than the Members of the Local Review Body and Mr Reppke who would provide procedural advice if required.

He advised that his first task would be to establish if the Members of the Local Review Body felt that they had sufficient information before them to come to a decision on the Review.

Councillor Hardie advised that he did not feel he had sufficient information before him to come to a decision on the review.  Councillor Trail advised that he felt he did have sufficient information before him.  Councillor Colville advised that he had taken on board the comments made by the applicant in respect of overdevelopment and would like to request further information and to hold a site visit.

Councillor Colville advised that he would like detail from the Planning Authority on the reasons why they felt the proposal would be over development of the site given that the applicant had advised that the plot was similar to that of surrounding properties.  He advised that he would like draft conditions from the Roads Department on the improvements required on the access road.  Councillor Colville advised he would like to request from the Applicant detail on the ownership of the part of the road which requires improvements and also some indication on the maintenance responsibilities of the other households that use the access road.  Councillors Trail and Hardie agreed with Councillor Colville.

Decision

The Argyll and Bute Local Review Body unanimously agreed –

1.    Agreed to hold a site visit to determine whether the proposed development on the site could be considered overdevelopment.

2.    Agreed to seek further information from the Planning Authority on the reasons that they considered the proposal on the site to be overdevelopment, having regard to the submissions from the applicant on the relative plot size of neighbouring properties.

3.    Agreed to request from the Roads Department draft conditions on required improvements to the access road which could accompany an approval of the proposed development should the Local Review Body be so minded.

4.    Agreed to request further information from the applicant on the exact ownership of the part of the access road requiring improvements as specified rights by the Roads Department; and an indication of the maintenance responsibilities of the other households in respect of the access road.
