CONSIDER NOTICE OF REVIEW REQUEST: ERECTION OF CROFT HOUSE: CROFT 1, LETTERSHUNA, APPIN, PA38 4BN (REF: 17/0004/LRB)

Minutes:

The Chair welcomed everyone to the meeting and introductions were made.  He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Reppke who would provide procedural advice if required.

 

The Chair referred to the previous meeting where it was agreed to continue consideration of this case to allow time to consider a competent Motion that would address the issues before the LRB.

 

Councillor Taylor referred to the site inspection and the discussion had at that meeting and advised that he would like to propose a modification to Condition 5 of the Planning consent.

 

Motion

 

1.    To agree to modify Condition 5 as follows:-

 

            (i)        The surfacing of the existing private access (in hot bituminous material, minimum depth 100mm) from its junction with the main road to a point 20 metres from the said junction and to delete the requirement for a turning head as the bin lorry can turn at the location of the recycling point.

           (ii)        No change.

          (iii)        No change

         (iv)        The provision of the bin store positioned as close as possible to the existing recycling facility but within land belonging to the Applicant.

 

2.    To agree the remainder of the Condition as originally worded; and

 

3.    To agree that these improvements are more balanced in terms of the development of a single house and will improve the opportunity for cars to enter and exit the private road from the public road and are more specific in their terms providing certainty as to the intent of the planning authority.

Councillor Kinniburgh also supported this Motion.

 

Decision

 

The ABLRB, having considered the merits of the case de novo, unanimously agreed to modify Condition 5 as outlined above.
