The Chair welcomed everyone to the meeting and explained that no person present would be entitled to speak other than the Members of the Local Review Body and Mr Reppke who would provide procedural advice if required.

 

The Chair invited the Members to advise whether or not they felt that they had sufficient information before them to come to a decision on the Review.

 

The Chair stated that he felt the information presented was confusing as it was unclear whether it was the access to the main road or access to the site which Condition 4 pertained to.

 

Mr Reppke agreed that the information was not particularly clear and that the appropriate persons from the Roads Department and the Planning Department and the applicant’s agent can be requested to confirm what their understanding of the condition is.

 

The Chair requested further information in the form of clarification of what section of road  Condition 4 refers to;  how this impacts on the other properties built off the same road and what responsibilities they have; and confirmation of land ownership.  Following on from receiving the further information and comments he recommended a site visit. 

 

Councillor MacMillan and Councillor Devon agreed that after receiving further information they felt it would be acceptable to have a site visit.

 

Decision

 

The Argyll and Bute Local Review Body unanimously agreed;

 

a)    to request from the Applicant, Roads and  Planning Departments  their written comments on the following matters:

 

i)              to provide clarity as to the length of  access to be improved as  referred to in Condition 4;

ii)             to explain how this Condition impacts on the other properties built along the same road;

iii)            to provide detail on what responsibilities these other properties have in relation to the maintenance of the  road to be improved; and

iv)           to provide confirmation of land ownership in respect of the roadway and adjacent landholdings in so far as can be established;

 

b)    to hold an accompanied site inspection to view the location of the proposed dwelling house and the access road to be improved.  The parties to attend being the Applicant and a representative from Planning and from Roads; and

 

c)    to adjourn the meeting and reconvene at the conclusion of the site inspection.

 

NB it was subsequently agreed to hold the site inspection on Wednesday 1 November 2017 at 10 am, followed by the reconvening of the Local Review Body at 10.30 am.
