Apologies for absence were received in advance of this meeting from Councillor Alex McNaughton.  Councillor David Kinniburgh attended the meeting in Councillor McNaughton’s place.

There were no declarations of interest.

The Chair welcomed everyone to the meeting and having established from Members that they had enough information before them to come to a decision on this case he invited them to comment further.

Councillor McCuish advised that it was clear to him that the decision made to refuse this application had been based on road safety grounds and that he was happy to support that decision and reason for refusal.

Councillor MacIntyre confirmed that he too supported this decision.  He noted that condition 3 had yet to be compiled with and he advised that this should be done by the Applicant.

Councillor Kinniburgh expressed sympathy with the situation the Applicant has found herself in regarding fly tipping.  He advised that trying to address this through the planning system was not appropriate as this was not a planning consideration and on the grounds of road safety he agreed that the Appeal should not be upheld.

Decision

The ABLRB, having considered the merits of the application de novo, decided to refuse the application for the reasons stated in the report of handling.
