The Chair welcomed everyone to the meeting and advised that the only parties entitled to speak at the meeting would be the Local Review Body Panel and Mr Jackson, who would provide procedural advice, if required.

 

The Chair asked the Panel if they considered that they had enough information before them to determine the request for review.

 

Councillor Kinniburgh advised that he did not feel he had sufficient information before him to come to a decision on the Review.  He advised that it was difficult to work from the plans that had been provided and added that it could be difficult to determine if the reason for refusal was justified without seeing the site.  Councillor Trail agreed with the comments of Councillor Kinniburgh.

 

The Chair highlighted that the Planning Department had advised that the site was too small for the development but the applicant was of the opinion that the site was sufficient in size to accommodate the development and acceptable amenity space and a precedent for this had been set at a development further down from the site.  He advised that he required clarification on this and seeing the site could be an advantage.

 

Councillor Trail highlighted that the applicant had given figures of the area of his site and advised that he would like written confirmation from the Planning department on the area of the site.  He advised that it would also be helpful if a location plan could be provided on a 1:1250 scale as opposed to the 1:10000 scale that had been provided in the papers.

 

The Panel further discussed the matter and agreed that if they received confirmation of the area of the site and a plan on a 1:1250 scale then a site visit would not be necessary at this stage.

 

Decision

 

Agreed to request further written submissions from the Planning Department in respect of –

 

Confirmation of the area of the site.

 

A location plan of the site on a 1:1250 scale.

The chair welcomed everyone to the meeting and advised that the only parties entitled to speak at the meeting would be the Local Review Body Panel and Mr Jackson, who would provide procedural advice, if required.

 

The Chair asked the Panel if they considered that they had enough information before them to determine the request for review to which the panel unanimously agreed that the plans submitted did not assist them in assessing the suitability of the site  for development of a dwellinghouse.

 

Decision

 

Agreed to hold an accompanied site visit to determine the suitability of the site for the erection of a dwellinghouse and requested that the applicant and Planning Authority attend to respond to any questions the Local Review Body may have.

The Chair welcomed everyone to the meeting and advised that the only parties entitled to speak at the meeting would be the Local Review Body Panel and Mr Reppke, who would provide procedural advice, if required.

 

The Chair asked members if they had all the information they needed to come to a decision on the review and they all agreed that they did have sufficient information.

 

The Chair then indicated that having looked at the small site and its location close to the newly built house he had concerns about this being overdevelopment of a small site which would be out of keeping with the current pattern of development.  It would also have an adverse impact of the amenity of the neighbouring property.  He suggested that it might well be possible to develop further in this locality provided that the plot was more appropriately sited and took account of the existing pattern of development which had larger plot sizes.  He felt that there were better ways of adding to the development in this area and therefore agreed with the reasons for refusal set out by the Planning Officers in their report of handling.

 

Councillor Kinniburgh said that he felt that the proposal was out of keeping with the pattern of development and was overdevelopment as determined by the Planning Officers.

 

Councillor Trail said that he agreed with his colleagues view on this application; that the application would represent overdevelopment and therefore supported the reason for refusal set out by the Planning Officer.

 

Decision

 

That the application for review be refused on the basis that the proposal was out of keeping with the current pattern of development which had larger plot sizes and a less intensive development within the site boundary.  There would be an adverse impact on the amenity of the neighbouring property and it could create an undesirable precedent for a more intensive urban style development pattern in this area which would be out of keeping with the wider settlement pattern and would constitute overdevelopment as set out in the planning report.
