There were no apologies for absence.

There were no declarations of interest.

The Chair, Councillor Gordon Blair, welcomed everyone to the meeting.  He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Ms Ledsom, who would provide procedural advice if required.

 

He referred to the previous meeting held on 13 October 2025 when it had been agreed to request further written information from the Planning Officer, and he invited Ms Ledsom to provide an update on matters relating to late and new information submitted.

 

Ms Ledsom explained that when the request was issued for further written information from Planning, all interested parties were given the opportunity of commenting on the further written information by the 12 November 2025.  The Roads Officer subsequently submitted comments a day late on 13 November 2025 and he circulated these to all other interested parties.

 

Following this late submission the Applicant submitted a further email referring to the contents of the late submission by the Roads Officer.

 

Ms Ledsom confirmed that it would be for the Members of the LRB to decide whether to accept the late comments from the Roads Officer and also the further email from the Applicant into the process.  If the LRB agree to accept these submissions it would be necessary for the LRB to treat these as New Information and give all interested parties the opportunity of commenting on these before reaching a decision on the Review.

 

The Chair sought comment from the Members of the LRB on whether to accept the late submissions from the Roads Officer and Applicant into the process.

 

The Members of the LRB agreed to accept the new information into the process and agreed that it be tabled at this meeting.  A short adjournment of 5 minutes was taken to read the new information. 

 

The Members of the LRB reconvened at 2.40 pm.

 

Having previously noted the requirement that this new information be issued to all parties for comment following this meeting, the Members of the LRB also considered whether they would require any further information.

 

Councillor Armour referred to the update from the Roads Officer and the comments on that from the Applicant.  He said he was aware that the Roads Officer had to ensure the legal process in terms of road safety was followed.  He advised that he would like to see the area for himself and suggested a site inspection take place.

 

Councillor Wallace said that he had been keen to progress this case but agreed to the suggestion of a site inspection.

 

Councillor Blair also agreed that a site inspection should take place with the Roads Officer and Planning Officer in attendance.

 

Councillor Armour also referred to the recommendation from the Roads Officer that a 7-day traffic survey be undertaken by the Applicant and the Members of the LRB agreed to request that the Applicant provide this traffic survey by 31 January 2026.  They also requested that the Roads Officer provide comments on the traffic survey submitted.

 

It was agreed that the site inspection and next meeting of the LRB should be held following receipt of the traffic survey and comments from interested parties.

 

Decision

 

The Members of the LRB agreed:

 

1.    to accept the late comments from the Roads Officer and comments on this from the Applicant into the process;

 

2.    to treat the above as New Information and give all interested the parties the opportunity to comment on it;

 

3.    to request the Applicant to carry out a 7-day traffic survey and submit this by 31 January 2026;

 

4.    to request the Roads Officer to comment on the traffic survey submitted;

 

5.    that following receipt of the traffic survey, comments from the Roads Officer, and any comments from interested parties on the submissions requested; to hold an accompanied site inspection at the earliest opportunity and request the attendance of the Roads Officer and Planning Officer;

 

6.    to hold a further meeting of the LRB at the conclusion of the site inspection;

 

7.    agreed that if the traffic survey is submitted earlier that 31 January 2026, timescales for receipt of other comments will be brought forward if possible.
