There were no apologies for absence.

There were no declarations of interest.

The Chair, Councillor Kieron Green, welcomed everyone to the meeting.  He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Jackson, who would provide procedural advice if required.

He advised that his first task would be to establish if the Members of the LRB felt that they had sufficient information before them to come to a decision on the Review.

Councillor Wallace stated that he would have expected photographs to be submitted but would be happy to proceed with the information given.

Councillor Hampsey was of the same view as Councillor Wallace.

Councillor Green referred to the comment from the Planners at page 16 of the pack for today’s meeting which confirmed that there may be scope for ABC Roads to re-consider their position. He also referred to the email from the Roads Officer on page 73 of the pack which advised that Roads would be willing to consider a reduction in the visibility splay requirements, if the applicant was able to provide a more recent sample (survey) with the same findings. He also said that given the traffic survey was carried out in 2021, he felt it would be appropriate to request an up to date traffic survey from the applicant.

Councillor Wallace said that he felt that the LRB could proceed on the basis of the survey provided in 2021 and thought it would be hard on the applicant to ask them for a further survey report but if the other Members thought an up to date report was necessary then he would go with along with that.

Councillor Wallace referred to page 77 of the pack and the comment that the Court of Session had struck down SPP2020 and reinstated SPP2014 and he would like clarity from the Roads Department on the SSP information, in terms of whether the access was assessed on the basis of SSP 2014 or SSP 2020. He also said that some photographs of the location would be helpful.

Councillor Hampsey confirmed that she was happy to support the request for an up to date survey and the further information requested by Councillor Wallace.

Decision

The members of the Argyll and Bute Local Review Body requested that the following information be submitted by 31^st January 2025 and a further hearing would be reconvened as soon as possible after that date.

1. An up to date Traffic Survey be carried out by the applicant and submitted into the process for consideration by the Roads Department and if appropriate an amended condition 2 from the Planners.

2. Clarification that the Roads Department have assessed the access issue in terms of the current rules and whether it was based on SSP 2014 or SSP 2020, and

3. Photographs of the access and the road at the site.
