Amanda Hampsey, welcomed everyone to the
meeting. She explained that no person
present would be entitled to speak other than the Members of the Local Review
Body (LRB) and Mr Jackson, who would provide procedural advice if required. She advised that her first task would be to establish if the
Members of the LRB felt that they had sufficient information before them to
come to a decision on the Review. All the Members of the LRB confirmed that they had
sufficient information before them to come to a decision on the Review. Councillor Wallace referred to condition 2 of the planning
consent and advised that he did not think it would be possible for the fence to
be lowered within the 3 months since the planning permission was granted in December
2022. He said that he thought that to
give an extension of one year would be a bit much and that his initial thoughts
were to extend the timescale by an extra 3 months. Councillor Hume agreed with the comments made by Councillor
Wallace and indicated that he would be agreeable to an extension of either 3
months or 6 months. Councillor Hampsey confirmed that
she would also be agreeable to an extension of 6 months and suggested amending
condition 2 to state that works should be completed by 30 September 2023. The Members of the Local Review Body were supportive of this
amendment to the condition and agreed that this would be a reasonable period of
time to give the Applicant to complete the work, noting that this would enable
the work to be completed during the summer months. Decision The Argyll and Bute Local Review Body, having considered the
merits of the case de novo, unanimously agreed to amend condition 2 of planning
consent reference: 22/01939/PP to read – 2. The
section of fence highlighted with a blue line on the approved site plan
1303/P/1-A shall be reduced to a minimum height of 1.5m as identified on the
plan to the satisfaction of the Council as Planning Authority. This work should be completed no later than
30 September 2023. Reason: In order to help
