The Chair, Councillor Kieron Green, welcomed everyone to the meeting.  It was noted that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Jackson, who would provide procedural advice if required.

 

He advised that his first task would be to establish if the Members of the LRB felt that they had sufficient information before them to come to a decision on the Review.

 

Both Councillor Irvine and Councillor McCabe said they had enough information.

 

Councillor Green advised that he thought that further information was required.  He referred to the question of exceptional need and said he would like an explanation from the Applicant as to why the exceptional case information was not submitted as part of the planning application.  He referred to the comments made by the Planning Officer that the exceptional case information submitted as part of this Notice of Review should not be considered as it was new information and that a new planning application should be submitted by Applicant.

 

Mr Jackson advised that if the Members were minded to give consideration to the information put forward in support of an exceptional case this would be appropriate and time could be given for the Planning Officer to comment on it.  He explained that the Regulations allowed for extensions to be given for receipt of any further information requested with interested parties, thereafter, being given 14 days to comment on the further information received.

 

Councillor McCabe advised that she would like to ask the Applicant why they did not submit the exceptional case information with the original application which, she noted, had been requested a number of times by the Planning Officer.

 

Decision

 

The Argyll and Bute Local Review Body agreed:

 

1.    To request the Planning Officer to submit in writing their assessment of the exceptional case information submitted by the Applicant as part of this Review and to extend the time for receipt of this information to 31 July 2022.

 

2.    To ask the Applicant to confirm in writing why the exceptional case information was never submitted with the planning application.

 

3.    To adjourn this meeting and reconvene once the further information was received along with any comments from interested parties.
