CONSIDER NOTICE OF REVIEW REQUEST:SITE FOR THE ERECTION OF A DWELLINGHOUSE, PLOT 2, LAND EAST OF ARDTEATLE COTTAGE DALMALLY (REF: 20/0006/LRB)

Minutes:

The Chair welcomed everyone to the meeting and introductions were made.  He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Jackson who would provide procedural advice if required.

 

He advised that his first task would be to establish if the Members of the LRB felt that they had sufficient information before them to come to a decision on the Review. Councillor Jean Moffat and Councillor Lorna Douglas both confirmed they had sufficient information in order to come to a decision.

 

Councillor Moffat stated that the site visit was very valuable by showing the state of the road to the plot and she felt it was vital that this was taken into account.

 

Councillor Douglas stated that the site visit clarified a lot of issues and having had the benefit of physically seeing the site and travelling along the road to get there, she now understood the significance of having passing places and why the road requires to be upgraded.

 

The Chair stated that the site visit had been very beneficial and he could see why two passing places would be required and why there was a need for that particular condition in this occasion. He endorsed the recommendation of the Roads Department in putting that condition in and supported taring of road for the 350 meters.

 

 Councillor Moffat agreed with the Chair that the condition of road was imperative to the build in relation to construction traffic and with two additional cars using the road once the build was complete and would be unsafe in its current state and without the passing places.

 

Councillor Douglas agreed with the Members and that the site visit allowed her to fully understand what was being recommended and why.

 

Decision

 

The Argyll and Bute Local Review Body, having considered the merits of the case de novo, agreed to refuse the appeal for the reasons stated in the report of handling.
