The Committee resolved in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 to exclude the public for the following item of business on the grounds that it was likely to involve the disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973.

The Committee heard evidence on behalf of both parties and unanimously agreed to adjourn at 5.p.m. 15 March 2010 and to reconvene at 2.30.p.m. on Thursday 18 March 2010.  When the Committee reconvened all parties were present and then continued with their submissions and the Committee then deliberated on the matter.

Decision

That the grounds of the Appeal had not been substantiated and the Appeal be therefore not upheld.
