The Committee resolved in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 to exclude the public for the following item of business on the grounds that it was likely to involve the disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973.

CIVIC GOVERNMENT (SCOTLAND) ACT 1982: APPLICATION FOR GRANT OF TAXI DRIVER'S LICENCE (R BURKE, DUNOON)

Minutes:

The Chair welcomed everyone to the meeting and outlined the procedure that would be followed.

 

The Applicant’s Agent presented the case on behalf of the Applicant and thereafter Inspector Wilson outlined the nature of the objection from Police Scotland.

 

Inspector Wilson responded to questions from the Applicant’s Agent and then after responding to a number of questions from Members both Inspector Wilson and the Applicant’s Agent were given the opportunity of summing up.

 

The Chair then asked those present to confirm they had received a fair hearing and they all confirmed this to be the case.

 

The Members then went on to determine the application.

 

Motion

 

To grant a taxi driver’s licence to the Applicant

 

Moved by Councillor Robin Currie, seconded by Councillor Rory Colville

 

Amendment

 

To refuse the application for grant of a taxi driver’s licence as the Applicant was not a fit and proper person.

 

Moved by Councillor George Freeman, seconded by Councillor Gordon Blair

 

The Motion was carried by 5 votes to 4 and the Committee resolved accordingly.

 

Decision

 

Agreed to grant a taxi driver’s licence to the Applicant which would be notified to the Applicant within 7 days and which would not come into force until 28 days had passed.
