CIVIC GOVERNMENT (SCOTLAND) ACT 1982: APPLICATION FOR GRANT OF TAXI DRIVER'S LICENCE (W KEENAN, OBAN)

Minutes:

The Chair welcomed everyone to the meeting and outlined the procedure that would be followed.  Thereafter he invited the Applicant to speak in support of his Application.

 

Applicant

 

Mr Keenan referred to the nature of his previous convictions.  He advised that in terms of the first one, this incident happened in 1999 and that he has not been involved in any similar incidents since then.  In respect of the two speeding convictions he advised that in both cases these had happened on the motorway on a clear road.  He advised that it was his view that there was no danger on the road, however, he acknowledged that this was no excuse for excess speed and that he had not realised the speed he was travelling at the time.

 

Having confirmed that she had no questions, the Chair invited Inspector McLeish to speak in respect of the representation submitted by Strathclyde Police.

 

Police

 

Inspector McLeish confirmed that the convictions listed in the Application form were correct and that she wanted to bring these to the attention of the Committee.

 

As the Applicant had no questions the Chair invited the Members to ask questions.

 

Members’ Questions

 

In respect of the two speeding fines, Councillor Freeman sought clarification on what speed Mr Keenan was travelling at on each occasion.

 

Mr Keenan advised that on the first occasion he was travelling at 94 mph on a 70mph stretch of motorway and on the second occasion he was travelling at 89 mph on a 70 mph stretch of motorway.

 

The Chair then invited Inspector McLeish and Mr Keenan to sum up.

Inspector McLeish advised that as previously stated the convictions listed on the Application form were correct and that Mr Keenan had confirmed the speed he was travelling at in respect of his speeding convictions.  She confirmed that some of the penalty points on his driving licence had now been dropped and that he now had 3 penalty points on his licence.

 

Applicant

 

Mr Keenan confirmed that he has slowed down his driving considerably over the years and advised that he had not realised that some of the penalty points had now been dropped from his driving licence.  He advised that he abided by speed limits in town and by schools.

 

The Chair asked Mr Keenan and Inspector McLeish to confirm if they had received a fair hearing and they both confirmed this to be the case.

 

Decision

 

Agreed to grant a Taxi Driver’s Licence to Mr Keenan.
