It was noted that Councillor Gordon Blair was not present.  As the meeting was inquorate, it was agreed to adjourn and reconvene at a later date.

 

The Argyll and Bute Local Review Body re-convened on Wednesday 24 September 2014 at 9.30am in the Council Chamber, Kilmory, Lochgilphead

 

Present:          Councillor Gordon Blair

                        Councillor David Kinniburgh

                        Councillor Richard Trail

 

Attending:        Charles Reppke, Head of Governance and Law

                        Hazel MacInnes, Committee Services Officer

 

The Chair welcomed everyone to the meeting and advised of the procedure that would be followed.  He advised that no party present would be permitted to speak during the meeting, other than the Local Review Body panel and Mr Reppke, who would provide procedural advice where required.

 

The Chair advised that his first task would be to establish whether or not the Panel felt they had sufficient information before them to determine the review.  Councillor Richard Trail and Councillor Gordon Blair both confirmed that they felt they had sufficient information before them to come to a decision.

 

Councillor Trail advised that while he had sympathy for the applicant in respect of the dampness he was experiencing, he felt it was a bit of an excessive response to put on an extension of such a large size.  He advised that he felt it was inappropriate and that it would have a considerable effect on the daylight entering the neighbouring properties.

 

Councillor Blair advised that he would expect to see a lot more applications for extensions from growing families that could not afford to move house.  He commented that he could not see any actual figures provided in the paperwork on the loss of daylight to the adjoining property.  Councillor Blair advised that although there were no figures provided he felt that the extension would have a detrimental effect on the neighbouring property and that he felt the size was inappropriate.

 

Councillor Kinniburgh stated that he also noted that there were no figures provided in respect of the lighting issue.  He advised that due to the direction the house was facing and the effect it would have on the adjoining property, he supported the planners reasons for refusal.

 

Decision

 

The Argyll and Bute Local Review Body agreed unanimously to refuse the request for review on the grounds that they agreed with the reasons for refusal given by the Planning Authority; and that the proposal would have an adverse impact on the daylighting and amenity of the neighbouring property, and was too large for the proposed site.
