The Chair welcomed everyone to the meeting and advised that parties to the Review were not permitted to address the Local Review Body.  He advised that the only participants entitled to speak would be the Members of the Local Review Body panel and Mr Reppke, who would provide procedural advice if required.

 

The Chair advised that his first task would be to establish whether or not the panel felt they had sufficient information in front of them to come to a decision on the review to which Members agreed that they did.

 

Members therefore proceeded to deliberate on the application.

 

The Chair advised that the decking that had been constructed was an eyesore and planning permission should be refused.

 

Councillor MacKay agreed and told the Panel that it was a shame the applicant had gone to all the expense of constructing the decking without gaining planning permission.  He added that Planners had advised that if the decking had been constructed just above ground level it would have been more suitable.  Councillor MacKay advised that the decking was contrary to planning policies LP ENV 1, LP ENV 14 and LP ENV19 and advised that he was in agreement with the reasons for refusal by the Planning Authority.  Councillor MacKay again highlighted that the Planning Authority had indicated that if the height if the decking was to decrease considerably, to just above ground level, then it may be considered more suitable, which may provide the applicant with some comfort.

 

Councillor McQueen agreed that the application should be refused.

 

Decision

 

The Argyll and Bute Local Review Body agreed unanimously to refuse the request for review on the grounds that they agreed with the reasons for refusal given by the Planning Authority.
